Is it legal to register any domain name?


Is it legal to register any domain name?



Someone told me that domains names are free-for-all, as in, anyone can register any domain provided it’s not taken.

Someone else told me that you can’t register domain names that are trademarked names, even if they’re available.

Which is correct?

Sort of both. There a big rush to register brand names and hold them to ransom – some paid off some didn’t. Now though most big brands have it sewn up but if they didn’t they would be able to sue for the right to take it from you and would win, as most judges would see it as intellectual property and or trademark infringement so it might as well be law.

Yes and it depends. It is all about what the domain name register you used can sell you at the time.

That’s mis-information – you can register any name you can think of that is not yet registered. However at any point you could be challenged by someone who owns a trademark the same or similar to your domain. If you lose the case, you will be forced to hand over the domain.
There is no system that checks domains that are registered against similar trademarks – it is up the trademark owner to register the domains that they think they would like to control.
